Tax Sale Procedures

How Do Tax Sales Work? Delaware Real Estate Lawyer

In Sussex, Kent or Castle counties, if you purchase a home through a public sale, the prior owner has 60 days to buy back the home by paying the amount bid at the sale and a 15 percent penalty.

How can tax sale procedures affect you? Call Brian Murray, Attorney at Law at 302-724-6082 or 866-920-8379 or e-mail our Newark office to schedule a free initial consultation.

In a tax deed sale, you purchase a tax lien certificate against the property in question. After the sale, the owner has 60 days to redeem or pay the amount bid at the sheriff's sale plus a penalty. This is called a tax sale redemption. If the owner of the property does not redeem the certificate, you can petition the court to begin auctioning off the property.

This tax sale redemption rarely happens but you should be prepared for it. At our firm, Brian T. Murray, has been providing legal counsel for people who purchased tax lien certificates through tax sale procedures and sheriff's sales since 1993.

Other issues in tax sales that you should be aware of include:

If you are taking title of a tax lien certificate purchased in a sheriff's sale, one of the issues may be removing the occupants after the redemption period. We will assist you in removing previous owners and tenants of your property.

During that sixty-day redemption period, you have limited control over the property. Any damage caused by the tenant or former owner can affect the property's value. An attorney can help you understand any potential pitfalls surrounding tax sales and assess whether you are in solid position to make the purchase.
